One of our brothers/sisters has asked this question:

Assalam walaikum,

I have always read or heard about the islamic women`s rights towards husband and also the punishments given to women for disobeying husband. Is there any such thing in the case of men? Are there no punishments or rules set against men for being unfaithful to wife, or sins of having relationships with other women? I would really like to know if there is anything related to my questions, from the Holy Quran or from teachings of Islam.

Answer:

Zina punishment from quran

In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is no one (no idol, no person, no grave, no prophet, no imam, no dai, nobody!) worthy of worship but Allah Alone, and we bear witness that Muhammad (saws) is His slave-servant and the seal of His Messengers.

Your Question: I have always read or heard about the islamic women`s rights towards husband and also the punishments given to women for disobeying husband. Is there any such thing in the case of men?

The Lord Creator Who created the man and the woman, also bestowed each gender with its distinct nature; and He, in His Supreme and Perfect Wisdom, guided each of them towards their distinct duties and responsibilities if they wish and choose to follow His approved ‘way of life’ called Al-Islam in the test period of this one short, transitory, worldly life.

Allah Says in the Holy Quran Chapter 2 Surah Baqarah verse 228 (part):

228 …. And the women shall have rights similar to the rights against them (in marriage) according to what is equitable; but men have a degree (of advantage) over them and Allah is Exalted in Power, Wise.

Contrary to the popular belief propagated by the educated-but-ignorant world, man and woman are not ‘equal’ but rather they are ‘balanced’! Islam has guided the wife to give certain rights and fulfill certain responsibilities towards her husband, and similarly guided the husband to give certain rights and fulfill certain responsibilities towards his wife; and this is precisely the test bestowed upon mankind by the All-Knowing, All-Wise Creator.

Allah Says in the Holy Quran Chapter 4 Surah Nisaa verse 34:

34 Men are the protectors and maintainers of women because Allah has given the one more than the other, and because they support them from their means. Therefore the righteous women are devoutly obedient and guard in (the husband's) absence what Allah would have them guard (their modesty, their honor, their property, etc.)

Although both are commanded to love, honor and cherish one another in marriage, the prime responsibility of the husband is to protect, maintain, support, and spend of his wealth on his wife and family; and in return, the prime duty and responsibility of the wife is to be devoutly obedient to her husband in absolutely all matters which are not against the commands of Allah and His Messenger (saws).

For example, if the husband commands his wife not to offer her obligatory prayers, or fulfill her obligatory fasts of Ramadan, or to adorn the ‘hijaab’, etc.; the husband will not be obeyed in these matters. But in matters which do not conflict with the commands of Allah and His Messenger (saws), it is the duty of the wife to be obedient to her husband. If the wife can bring herself to fulfill her duties towards her husband in marriage, her reward will be nothing short of Paradise!

Al-Tirmidhi Hadith 3254 Narrated by Anas ibn Malik

Allah's Messenger (saws) said, "When a woman observes the five times of prayer, fasts during Ramadan, preserves her chastity and obeys her husband, she may enter by any of the gates of Paradise she wishes."

Al-Tirmidhi Hadith 3256 Narrated by Umm Salamah

Allah's Messenger (saws) said, "Any woman who dies when her husband is pleased with her will enter paradise."

Although the husband is not commanded to be ‘obedient’ to his wife, it is his responsibility and duty in Islam to love, cherish, honor, support, maintain, and above all, spend of his means on his wife and family.

Al-Tirmidhi Hadith 278 Narrated by Abu Hurayrah

The Prophet (saws) said: ‘The most perfect Muslim in the matter of faith is one who has excellent behaviour; and the best among you are those who behave best towards their wives.’

Al-Tirmidhi Hadith 3263 Narrated by Aisha

Allah's Messenger (saws) said, "Among the believers who show most perfect faith are those who have the best disposition, and are kindest to their families."

Al-Tirmidhi Hadith 3252 Narrated by Aisha ; Abdullah ibn Abbas

Allah's Messenger (saws) said, "The best of you is he who is best to his family, and I am the best among you to my family.”

If both, the husband and the wife, fulfill their duties and responsibilities towards each other as commanded by their Lord, it would make for a loving, harmonious, tranquil and peaceful relationship.

Your Question: Are there no punishments or rules set against men for being unfaithful to wife, or sins of having relationships with other women? I would really like to know if there is anything related to my questions, from the Holy Quran or from teachings of Islam.

Allah Says in the Holy Quran Chapter 24 Surah Noor verses 30-31:

30 Say to the believing men that they should lower their gaze and guard their modesty: that will make for greater purity for them: and Allah is well acquainted with all that they do.

31 And say to the believing women that they should lower their gaze and guard their modesty.

Allah Subhanah has commanded both the man and the woman to scrupulously guard their modesty; and regardless of who amongst them transgresses their boundary and chooses to be unfaithful in marriage, the prescribed punishment of those guilty of the abomination of ‘zina’ (adultery) in Shariah is exactly the same for the man as well as the woman: that is, to be stoned until death!

Sahih Al-Bukhari Hadith 8.809 Narrated by Ibn Umar

A Jew and a Jewess were brought to Allah's Messenger (saws) on a charge of committing an illegal sexual intercourse. The Prophet (saws) asked them. "What is the legal punishment (for this sin) in your Book (Torah)?" They replied, "Our priests have innovated the punishment of blackening the faces with charcoal and Tajbiya." Abdullah bin Salam (a companion of the Prophet (saws) who had converted from Jewish to Islam) said, "O Allah's Messenger (saws), tell them to bring the Torah." The Torah was brought, and then one of the Jews put his hand over the Divine Verse of the Rajam (stoning to death) and started reading what preceded and what followed it. On that, Ibn Salam said to the Jew, "Lift up your hand." Behold! The Divine Verse of the Rajam was under his hand. So Allah's Messenger (saws) ordered that the two (sinners) be stoned to death, and so they were stoned.

Sahih Al-Bukhari Hadith 9.432 Narrated by Ibn Umar

The Jews brought a man and a woman who had committed illegal sexual intercourse, to the Prophet (saws), and he (saws) ordered them to be stoned to death, and they were stoned to death near the mosque where the biers used to be placed.

If one or both amongst the man or the woman who are convicted of committing ‘zina’ are unmarried, the punishment for the unmarried person prescribed in Shariah is a hundred lashes in public.

Allah Says in the Holy Quran Chapter 24 Surah Noor verse 2:

2 The woman and the man guilty of ‘zina’ (fornication) flog each of them with a hundred stripes: let not compassion move you in their case in a matter prescribed by Allah, if ye believe in Allah and the Last Day: and let a party of the believers witness their punishment.

This prescribed punishment of a hundred lashes (for fornication) and being stoned to death (for adultery) is only what a righteous society extracts from those who are convicted of the abomination of ‘zina’ in the life of this world. Allah is our witness, if they do not sincerely repent for their evil deed before their appointment of death, their punishment in the Hereafter in the Presence of their Majestic Lord would be very severe indeed!

Whatever written of Truth and benefit is only due to Allah’s Assistance and Guidance, and whatever of error is of me alone. Allah Alone Knows Best and He is the Only Source of Strength.

Your brother and well wisher in Islam,

Burhan
