Received blood money for father death.

i have two questions to ask,

1)my father met with an accident in uae some six years back and subsequently he died after a year due to unrelated reason to the accident,now after six years we the children of the victim got exgratia according to the law of uae as a compensation of loss to the body, now my question is whether taking that money is allowed for us or not, as the money is released by the "insurance company not the accident maker", and it is not clear from my father that at whose fault the accident happened.

Received blood money for father death

In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is none worthy of worship but Allah Alone, and we bear witness that Muhammad (saws) is His slave-servant and the seal of His Messengers.

 

If your father had indeed met with an accident and suffered loss of life or limb because of that accident, and the law-courts of the land found the ‘accident maker’ guilty for the accident and awarded or directed that an amount of ‘diya’ or blood money be paid for the loss to the victim (or to his heirs in the event of the death of the victim)………….. regardless of whether the ‘accident-maker’ or any third party is commanded by the courts to pay the ‘diya’, the absolute majority of the scholars and jurists in Islam are of the opinion that the acceptance of the ‘diya’ or ‘blood-money’ is absolutely lawful for the victim and/or his heirs.

 

Whatever written of Truth and benefit is only due to Allah’s Assistance and Guidance, and whatever of error is of me alone. Allah Alone Knows Best and He is the Only Source of Strength.
