My husband commits shirk

One of our brothers/sisters has asked this question:

 my husband commits shirk knowingly, he wears a black string and despite evidences provided from Quran and hadith he still wont take it off fearing he wont be protected from evil. Is our nikah even valid anymore? also when we did nikah niether of us was practising. I had no wali although i think one of the men conducting it acted as my wali as i come from non muslim family. a mahr was set but my husband pretended to give it to me in front of people and then took it back after they left. he refuses to pray he doesnt think we have time in our days to pray 5 times a day. are we even married? because i want a divorce if we are inshallah

Answer:

In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is none worthy of worship but Allah Alone, and we bear witness that Muhammad (saws) is His slave-servant and the seal of His Messengers.

Sister all that you have narrated does not warrant a divorce. Yes its a great sin not to practice Islam by praying etc., or doing some sort of shirk/bidaa, or even the fact that he has not paid the mehr as yet. All these shortfalls can be rectified.
 

What we understand is that you want out of this marriage. If you feel you cannot bear living with your husband, then there is nothing that can stop you from asking for a divorce. Nowadays you can even separate for un-reconcialble reasons.
