My question is that Can they marry??? i m going to mention you the conditonss under with all details,, 1) 1 lady gave her milk to her brother in laws`s son when he was a child named sajid.

One of our brothers/sisters has asked this question:

Assalamoaliakumm!!

 

My question is that Can they marry??? i m going to mention you the conditonss under with all details,,

 

1) 1 lady gave her milk to her brother in laws`s son when he was a child named sajid.

2) That boy (Sajid) is having now 1 younger sister named nelum.

3) That lady who gave milk is having daughter in law named samra.

4)That lady also having 1 unmarried son named Mushtaaq.

i)) Now the familly wants to make marriage Sajid" with Samra (sajid is the same boy who was feed by the grandmother of samra)

ii)) Family is also arranging 2nd marriage Neelum with Mushtaq (Mushtaaq is the real son of that lady who feed sajid & Sajid & neelum are real sister & borthers.

i know it will b little difficult but plz help us in this matter that Can they marry,, i mean are they allowed to get marriage by Islamic point of view.

Foster relationship

In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is none worthy of worship but Allah Alone, and we bear witness that Muhammad (saws) is His slave-servant and the seal of His Messengers.

 

Beloved Sister, there seems to be a slight contradiction or we are unable to understand whether ‘Samra’ is the daughter-in-law or the grand-daughter of the lady who give suck to Sajid; anyways, we will strive to present the rulings for both relations in light of the guidance of the Quran and the Sunnah, Insha Allah.

 

Allah Says in the Holy Quran Chapter 4 Surah Nisas verse 23:

23 Prohibited to you (for marriage) are: your mother, daughters, sisters, father's sisters, mother's sisters, brother's daughters, sister's daughters, foster-mothers (who gave you suck), foster-sisters, your wives' mothers, your step-daughters under your guardianship born of your wives to whom ye have gone in no prohibition if ye have not gone in, (those who have been) wives of your sons proceeding from your loins, and two sisters in wedlock at one and the same time except for what is past; for Allah is Oft-Forgiving Most Merciful.

 

Every relationship which becomes ‘haraam’ or ‘sacred’ because of blood-relation in Shariah, will also become ‘haraam’ or sacred because of taking suck when in one’s infancy.

 

Q-1: Now the familly wants to make marriage Sajid" with Samra (sajid is the same boy who was feed by the grandmother of samra)

Ref-3) That lady who gave milk is having daughter in law named samra.

If ‘Samra’ is the ‘daughter-in-law of the lady who gave suck to ‘Sajid’ (as stated in point-3 of your question), then there is absolutely no harm if ‘Sajid’ were to marry ‘Samra’ after she has sought divorce from her present husband.

 

But if ‘Samra’ is the grand-daughter of the lady who gave suck to ‘Sajid’; then it would not be permissible and absolutely forbidden in Shariah for ‘Sajid’ to marry any daughter, or grand-daughter, etc. of the lady who gave him suck. ‘Samra’ being the grand-daughter of the lady who gave suck to ‘Sajid’, would be considered the niece of ‘Sajid’; and uncles and nieces are considered ‘mehrams’ in Shariah. Thus such a marriage would be absolutely forbidden and impermissible in Shariah Law.

 

Q-2: amily is also arranging 2nd marriage Neelum with Mushtaq (Mushtaaq is the real son of that lady who feed sajid & Sajid & neelum are real sister & borthers.

Because the lady gave suck only to ‘Sajid’ and not to ‘Neelum’, it is ‘Sajid’ alone who becomes a ‘mehram’ to the lady and all her blood-relatives. It would be absolutely permissible in Shariah for ‘Mushtaq’ to marry ‘Neelum’ as they are not ‘mehrams’.

 

Whatever written of Truth and benefit is only due to Allah’s Assistance and Guidance, and whatever of error is of me alone. Allah Alone Knows Best and He is the Only Source of Strength.
