Remarry husband after divorce

In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is no one (no idol, no person, no grave, no prophet, no imam, no dai, nobody!) worthy of worship but Allah Alone, and we bear witness that Muhammad (saws) is His slave-servant and the seal of His Messengers.

 

Allah Says in the Holy Quran Chatper 2 Surah Baqarah verses 229-230:

229 A divorce is only permissible twice: after that the parties should either hold together on equitable terms or separate with kindness. It is not lawful for you (men) to take back any of your gifts (from your wives) except when both parties fear that they would be unable to keep the limits ordained by Allah. If ye (judges) do indeed fear that they would be unable to keep the limits ordained by Allah there is no blame on either of them if she give something for her freedom. These are the limits ordained by Allah; so do not transgress them. If any do transgress the limits ordained by Allah such persons wrong (themselves as well as others).

230 So if a husband divorces his wife (irrevocably) he cannot after that remarry her until after she has married another husband and he has divorced her. In that case there is no blame on either of them if they reunite provided they feel that they can keep the limits ordained by Allah. Such are the limits ordained by Allah which He makes plain to those who understand.

 

To protect the rights of women, Islam permits the process of divorce and remarriage to the same person only twice; if the husband pronounces divorce on his wife for a third time, it would constitute an ‘irrevocable’ divorce, and it is impermissible for the same couple to marry again unless and until per chance, the woman marries another man and that man, of his own free will, divorces her or dies.

‘Khula’ in Fiqh or Jurisprudence term means that the wife initiates the divorce.

 

If the wife initiated divorce, and requested the husband to divorce her and he acceded to her request and himself pronounced divorce on her only once (or twice), and the divorce was duly finalized; there is absolutely no harm if the two wish to re-marry again in the future, provided all the obligatory conditions of marriage are fulfilled. (proposal and acceptance, determination of a new mehr, presence of two witnesses, and the consent of the guardians of the woman).

 

In the case where the husband did not himself pronounce the divorce, but rather the wife had to initiate her divorce proceedings in a Shariah Court when seeking ‘khula’, and the Shariah Judge was the one who declared the divorce; then in this case the husband looses the right to re-take his wife back during the ‘iddah’ or waiting period of divorce, and it would count as one divorce. After the ‘iddah’ or waiting period of divorce is over, the couple can re-marry again provided all the obligatory conditions of a new marriage are fulfilled.

 

Thus in conclusion, the process of divorce and re-marriage can only take place twice in any one marriage; if they divorce for the third time, then that divorce is irrevocable and they cannot re-marry unless and until per chance, the woman marries another man and that man, of his own free will, divorces her or dies.
