DEAR BAHI BURHAN,

 

ASSALAM O ALAIKUM

 

PRAISE DUE TO ALLAH THE ALMIGHTY AND MAY ALLAH'S PEACE MERCY AND BLESSING BE UPON OF YOU AND MAY ALLAH WILL SAFE ALL OF US  FROM THE HELL FIRE.

 

DEAR BAHI, I AM MARRIED WITH MY WIFE WHICH IS NOT FROM THE SAME COUNTRY, AND ALHAMDULILLAH ALLAH GIVE US TWO BEAUTIFUL DAUGHTERS.  NOW, WE ARE LIVE IN MY WIFE'S COUNTRY , AND I AM AS A FOREIGNER IN WHICH MANY RESTRICTION  AND REGULATION OF IMMIGRATION LAW HAS TO FOLLOW. 

 

BUT, OUR FINANCIAL HAS NOT YET SUPPORT TO OBEY EACH OF LAW. I HAVE TO WRITTEN AND MAKE FALSE STATEMENT ABOUT MY SECOND DAUGHTER'S BIRTH CERTIFICATE . THERE MENTIONED THAT MY DAUGHTER HAS BEEN BORN OUTSIDE THE MARRIAGE ( NOT MENTIONED MY NAME AS A FATHER, ONLY MENTIONED WAS BORN FROM A LADY NAME OF .... MY WIFE NAMES, OUTSIDE MARRIAGE )

 

THIS FALSE CERTIFICATE I MADE TO AVOID ANY FEES OF LIMITED STAY PERMIT FOR HER, WHICH IS VERY EXPENSIVE .  BUT FOR MY FIRST DAUGHTER I REGISTRATE HER NAME AND HER BIRTH CERTIFICATE MENTIONED MY NAME AS A FATHER AND PAY FOR HER LIMITED STAY PERMIT FEE.

 

PLEASE CLARIFY FOR ME , IS IT ALLOW IN ISLAM ACCORDING TO QURAN AND HADIST THAT I MAKE A FALSE STATEMENT ABOUT MY SECOND DAUGHTER STATUS WHEN BORN OUTSIDE MARRIAGE, TO AVOID ANY FEES.

False Statement Legal

In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is no one (no idol, no person, no grave, no prophet, no imam, no dai, nobody!) worthy of worship but Allah Alone, and we bear witness that Muhammad (saws) is His slave-servant and the seal of His Messengers.

 

Your Question: PLEASE CLARIFY FOR ME , IS IT ALLOW IN ISLAM ACCORDING TO QURAN AND HADIST THAT I MAKE A FALSE STATEMENT ABOUT MY SECOND DAUGHTER STATUS WHEN BORN OUTSIDE MARRIAGE, TO AVOID ANY FEES.

Beloved Brother, it would not behove the character of a true believer in Allah and the Last Day to lie or give false witness. Allah Subhanah commands the believers to always speak the Truth and give witnesses on the side of the Truth, even if it be against one’s own self.

 

Allah Says in the Holy Quran in Chapter 4 Surah Nisaa verse 135:

O ye who believe! Stand out firmly for justice as witnesses to Allah, even as against yourselves, or your parents, or your kin, and whether it be (against) rich or poor: for Allah can best protect both. Follow not the lusts (of your hearts) lest ye swerve, and if ye distort (justice), or decline to do justice; verily Allah is well-acquainted with all that ye do.

 

Allah Says in the Holy Quran Chapter 33 Surah Ahzab verse 70:

70 O ye who believe! Fear Allah and (always) say a word directed to the Right.

 

Sahih Al-Bukhari Hadith 8.7 Narrated by Abu Bakra

Allah's Messenger (saws) said thrice, "Shall I not inform you of the Biggest of the Great Sins?" We said, "Yes, O Allah's Messenger (saws)" He (saws) said, "To join partners in worship with Allah; to be undutiful to one's parents." The Prophet sat up after he (saws) had been reclining and added, "And I warn you against giving forged statement and a false witness!; I warn you against giving a forged statement and a false witness!" The Prophet (saws) kept on saying that warning till we thought that he (saws) would not stop!’

 

Sahih Al-Bukhari HadithH4.712 Narrated by Wathila bin Al Asqa

Allah's Messenger (saws) said, "Verily, one of the worst lies is to claim falsely to be the son of someone other than one's real father, or to claim to have had a dream one has not had, or to attribute to me what I have not said."

 

Sahih Al-Bukhari Hadith 8.116 Narrated by Abdullah

The Prophet (saws) said, "Truthfulness leads to righteousness, and righteousness leads to Paradise. A man keeps on telling the truth until he is recorded with Allah as ‘a truthful person’. Falsehood leads to Al-Fajur (i.e. wickedness, evil-doing, etc.), and Al-Fajur leads to the (Hell) Fire! A man may keep on telling lies till he is written before Allah, ‘a liar’."

 

In light of the above commands of Allah and His Messenger (saws) it would indeed be a grave sin and not befit the character of a true believer to lie in order to gain a small advantage for himself in this world!

 

Beloved brother, although you might feel at this time that the false statement might give you a little, albeit illegal, relief, the repercussions that this statement might have in the future when it comes to the Shariah legalities of mehram relations, marriage, and especially inheritance, etc. the consequences might truly be disastrous! Allah forbid, if your daughter grows up and marries someone who is a mehram to her, but because of the legal papers, that person would now prove to be a non-mehram to her! Or Allah forbid, because she is not legally named as your daughter, she is deprived of her legal inheritance after your death!

 

Beloved Brother, Allah might change your financial condition in the future; but if you fulfill your plan to register her as an illegitimate child born out of wedlock, the stigma that your child will carry all her life of being illegitimate will remain with her forever!

 

Beloved Brother, we implore you in the name of Allah to fear Him, and do the righteous thing and not make a false statement regarding the legitimate birth of your beloved child. Allah is our witness, if the child is deprived tomorrow of any of her legal rights because of this one forged statement, the burden of guilt and sin that you will have to bear in the Just and Supreme Court of Allah Subhanah will be unbearable indeed!

 

If you have already submitted the false statement, seek sincere repentance from your Lord Most Merciful for the error, and strive your utmost to put things aright. If you have not yet submitted the false statement, we beseech and implore you to fear Allah, and do only what is Right and aligned to the Truth.

 

Whatever written of Truth and benefit is only due to Allah’s Assistance and Guidance, and whatever of error is of me alone. Allah Alone Knows Best and He is the Only Source of Strength.
