Man can force his wife to have sex with him..

Mu' meneen Brothers and Sisters,

As Salaam Aleikum wa Rahmatullahi wa Barakatuh. (May Allah's Peace, Mercy and Blessings be upon all of you)

One of our brothers/sisters has asked this question:

Non muslims often refer to the following hadith as rape.

Sahih Al-Bukhari Hadith 4.460 Narrated by Abu Huraira

Allah`s Messenger (saws) said, "If a husband calls his wife to his bed (i.e.
to have sexual relation) and she refuses and causes him to sleep in anger,
the Angels will curse her till morning."

.. and that man can force his wife to have sex with him..

Ive read elsewhere the below:
"Quoting Quran, Dr Amin says that a husband has to take the consent of his wife for physical relationship."

Any ideas what chapter and verse this is?

Answer:

Husband force wife sex rape

In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is none worthy of worship but Allah Alone, and we bear witness that Muhammad (saws) is His slave-servant and the seal of His Messengers.

Your Question: Non muslims often refer to the following hadith as rape. .. and that man can force his wife to have sex with him..
Allah Says in the Holy Quran Chapter 30 Surah Rome verse 21:

21 And among His Signs is this that He created for you mates from among yourselves that ye may dwell in tranquillity with them and He has put love and mercy between your (hearts); verily in that are Signs for those who reflect.

Al-Tirmidhi Hadith 278 Narrated by Abu Hurayrah

Sahih Muslim Hadith 3469 Narrated by Abu Hurayrah

Allah's Messenger (saws) said: a believing man should not hate a believing woman (his wife); if he dislikes one of her characteristics, he will be pleased with another.

Al-Tirmidhi Hadith 3358 Narrated by AbuBakr as-Siddiq

The Prophet (saws) said, "One who treats badly those under his authority will not enter Paradise."

Abu Dhar al-Ghafari reported: The Messenger of Allah (saws) said: there is a reward for you [even] in sex with your wife." The companions asked: O Messenger of Allah (saws) is there a reward if one satisfies his passion?" He (saws) said: "Do you know that if he satisfies it unlawfully he has taken a sin upon himself? Likewise, if he satisfies it lawfully, he is rewarded."

Beloved brother in Islam, if one uses basis common sense, one would realize that if Islam gave permission, or allowed, or encouraged the concept that a husband is allowed or permitted to force his wife to have sexual relations with him, there would have been absolutely no need to declare such rewards and warnings to the spouses bonded in the sacred bond of marriage!

The only lawful route in Shariah for both, the man and the woman, to fulfill their natural physical desire for sex is through the sacred institution of marriage; and Islam enjoins both the husband and the wife to fear Allah their Lord, fulfill the duties and responsibilities that have been laid on each in the marriage, and basically leave no stone unturned in fulfilling each others lawful needs, wants, and desires in their sacred bond.

Your Statement: Ive read elsewhere the below:
"Quoting Quran, Dr Amin says that a husband has to take the consent of his wife for
physical relationship."

To the best of our knowledge, we are not aware of any such verse or guidance in the Holy Quran; but it is obvious from the various guidance available in the Quran and the Sunnah that the wife (nor the husband) should refuse the invitations of their spouse when they are invited by the other to fulfill their lawful desires.

If one is bonded in a marriage where the wife constantly refuses her husbands invitations (or vice versa), both parties are well within their rights in Islam to seek a separation through the institution of divorce.

Whatever written of Truth and benefit is only due to Allahs Assistance and Guidance, and whatever of error is of me alone. Allah Alone Knows Best and He is the Only Source of Strength.

Your brother and well wisher in Islam,

Burhan
