Mu' meneen Brothers and Sisters,

One of our brothers/sisters has asked this question:

can husband and wife still have sex if husband moves out of home and stays else where on the reasons that he can not stay here in peace?how long can this go on because husband does not want a divorce?

Answer:

Sex living apart

In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is none worthy of worship but Allah Alone, and we bear witness that Muhammad (saws) is His slave-servant and the seal of His Messengers.

As long as the husband and wife choose to remain married and a divorce is not established between them, it is lawful and they are at absolute liberty to enjoy conjugal relations with each other, absolutely regardless of whether they choose to live together in the same house or separate from each other.

Whatever written of Truth and benefit is only due to Allah’s Assistance and Guidance, and whatever of error is of me alone. Allah Alone Knows Best and He is the Only Source of Strength.
