You say in one of the answers (question 1797) that a husband and wife can sleep togather and kiss and fondle, even fondle the genitals of each other while fasting. How come you justify this. ISnt the NAFS violated.

 

Is there any HAdith to justify your answer?

Kiss and touch sex while fasting

In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is none worthy of worship but Allah Alone, and we bear witness that Muhammad (saws) is His slave-servant and the seal of His Messengers.

 

Dear and beloved brother in Islam, that particular answer was in response to a specific ‘legal’ question asked whether if one sleeps alongside one’s spouse during the fasting hours, or they kiss each other, or if the husband fondles or presses the breast of his wife, or the wife touches the private organ of her husband…..would such acts legally violate the validity of one’s fast.

(The exact question asked was: ‘During fasting sexual intercourse is Haram, it is clearly mentioned in Quran, there is no doubt. but I want to know can we sleep with our husband during fast, can kiss each other, If my husband fondle or press my breast or I touches his organ then there is any affect in our Fast.’)

In light of the guidance of the Quran and the Sunnah, there are basically five things which will break or invalidate the fast:

  1. Intentional eating
  2. Intentional drinking
  3. Sexual intercourse
  4. voluntary semen discharge
  5. the menstruation of the woman while fasting

 

Thus although it would be best for one who is fasting to fear Allah and abstain from getting sexually active with one’s wife, unless and until one actually penetrates one’s wife through sexual intercourse or the semen (mani) is discharged, the touching or the kissing by itself would not ‘legally’ invalidate one’s fast in the Sight of Shariah.

Sahih Muslim Hadith 2450 Narrated by Umar ibn al-Khattab

Hadrat Umar ibn Khattab (r.a.) asked the Messenger of Allah (saws): ‘Should one observing fast kiss (his wife)?’ The Messenger of Allah (saws) said to him: ‘Ask her (Umm Salamah (r.a.), the wife of the Prophet (saws)). She informed him that the Messenger of Allah (saws) did that (kissed her while he (saws) was fasting), whereupon Hadrat Umar (r.a.) said: ‘O Messenger of Allah (saws), Allah has pardoned thee all thy sins, the previous and the later ones.’ Upon this the Messenger of Allah (saws) said: ‘By Allah, I am the most God-conscious amongst you, and I fear Allah most amongst you.’

 

Sahih Al-Bukhari Hadith 3.149 Narrated by Aisha

The Prophet (saws) used to kiss and embrace (his wives) while he (saws) was fasting, and he (saws) had more power to control his desires than any of you.
