Answer:

Girl raped

In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is none worthy of worship but Allah Alone, and we bear witness that Muhammad (saws) is His slave-servant and the seal of His Messengers.

Ali reported that the Prophet (saws) said: "The pen is raised for three groups [of people--that is, they will not be responsible for any of their actions: the insane until they become sane, those who are sleeping until they awaken, and the child until they reach puberty."

Related by Ahmad, Abu Dawud, and at-Tirmidhi.

If the girl who was raped happened to be a minor, then she will be absolutely and totally blameless for the abomination of a crime the evil-doer committed against her: not only in the laws of this world, but also in the Court of the Lord Most High. The rapist alone will bear the burden of his ghastly crime in this world and in the Hereafter.

Allah says in the Holy Quran Chapter 33 Surah Ahzaab verse 59:

O Prophet, enjoin your wives and daughters, and the believing women, that they should cast their outer garments over their persons. It is expected that they will thus be recognized, and not molested. Allah is Oft-Forgiving, Most Merciful.

But if the woman was an adult (passed the age of puberty and understanding), honored the laws, conditions, restrictions, and inter-actions with non-mehram members of the opposite sex as prescribed in Islam…..and if even then she is molested or raped; she will be absolutely blameless, and the evil-doer who molested or raped her will alone bear the burden of this ghastly crime.

But if the woman violated the laws, conditions, restrictions, and inter-actions with non-mehram members of the opposite sex as prescribed in Islam…..whereby her apparel, and her adornments, and her beauty, etc. were exposed in the presence of non-mehram men, or she casually and freely inter-acted, talked, met, dated, etc. with them……..; if such a woman is unfortunately molested or raped; although the brunt of the burden of the sin will be borne by the evil molester or rapist, she too will have a share of the sin for her seduction, even if it was unintentional on her part!

Sahih Muslim Hadith 6840 Narrated by Abu Hurayrah

Allah's Messenger (saws) said: ‘There are two types, amongst the denizens of Hell, I have yet not seen them. One possessing whips like the tail of an ox and they flog people with them. (The second one:) the women who would be naked in spite of their being dressed, who are seduced (to wrong paths) and seduce others with their hair high like humps. These women would not get into Paradise and they would not perceive the odour of Paradise, although its fragrance can be perceived from such and such distance (from great distance).’

Whatever written of Truth and benefit is only due to Allah’s Assistance and Guidance, and whatever of error is of me alone. Allah Alone Knows Best and He is the Only Source of Strength.

Your brother and well wisher in Islam,

Burhan
