Answer:
Speaking before Marriage
In the name of Allah, We praise Him, seek His help
and ask for His forgiveness. Whoever Allah guides none can misguide, and
whoever He allows to fall astray, none can guide them aright. We bear witness
that there is no one (no idol, no person,
no grave, no prophet, no
imam, no dai, nobody!) worthy of worship but Allah Alone,
and we bear witness that Muhammad (saws) is His slave-servant and the seal of
His Messengers.
Beloved brother, the rite of ‘engagement’ has
absolutely no legal basis in Islam, and the boy and girl would remain and be
considered non-mehrams, and all the restrictions that apply to non-mehrams
would be liable upon them until they have performed their ‘nikaah’.
There is absolutely no harm if one wishes to speak
to one’s fiancé, provided she is accompanied by one of her male mehram
relatives (father, uncle, brother, etc.); but to talk to the girl alone without
the presence of her mehram relative would indeed be a transgression of the
boundaries of Allah Subhanah and thus a sin.
It would be best to perform the ‘nikaah’ with the
girl one is engaged to as soon as possible, for then the relationship would be
absolutely legal in the Sight of Islamic Law and of Allah Subhanah.
Whatever written of Truth and benefit is only due
to Allah’s Assistance and Guidance, and whatever of error is of me alone. Allah Alone Knows Best and He is the Only
Source of Strength.
Your brother and well
wisher in Islam,
Burhan
