Distribution between brothers & sisters of income from parental property.

One of our brothers/sisters has asked this question:

As-Salamu Alaykum,

Brother Burhan,

 

My parents have expired six years ago and have not left any will for us, we have few properties with us from which some money is collected as rent (details of which is listed below)

 

Details:

1)      Family members: 2 Sons and 3 Daughters (all adult)

2)      Net Income till date after expiration of parents : Rs 10, 39,954.00

Q.1: What will be the distribution amount to each son and each daughter?

 

Q.2: What will be the distribution ratio between son and each daughter for distribution of Income in future?

 

Q,3: Will the Zakaat amount be calculated on united income or will it be calculated after distribution to all the beneficiaries?

 

Kindly state the relevant references for above.

Answer:

In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is none worthy of worship but Allah Alone, and we bear witness that Muhammad (saws) is His slave-servant and the seal of His Messengers.

The distributions of the assets if both your parents and the parents of your father are deceased should be made as follows:-

 
Each daughter will receive Rs. 1,48,565/- 
Each son to receive            Rs. 2,97,129/50
 
In future whatever amount you accumulate you should divide the same into 7 shares, then distribute as follows:
 
each daughter to receive 1 share
each son to receive         2 shares
 
Zakat must be paid by each one individually. They should individually merge their amounts to their other assets and pay the zakat 2.5% on their total equity.
